Legal protection begins before pregnancy

What truly distinguishes our model is when legal protection is established. Before any embryo transfer takes place, our legal team secures a formal judicial authorization issued by a Federal Judge, formally recognizing the Intended Parents.

This is the legal foundation that ensures parental status from the outset and allows the entire process to move forward with clarity and trust. It creates certainty for the Intended Parents, the surrogate and the medical team, and allows the pregnancy to be approached with greater emotional peace. Addressing legal matters before pregnancy changes the entire surrogacy experience.

A clear agreement, fully supported

Once legal authorization is in place, we coordinate a brief visit to Mexico to formalize the surrogacy agreement before a Notary Public.

The agreement reflects the Intended Parents’ decision to build a family, confirms the surrogate’s voluntary and supported participation, and establishes clear expectations for everyone involved.

Legal FAQs – Surrogacy in Mexico

Before any medical treatment begins, a final court ruling is obtained recognizing the intended parents as the sole legal parents of the baby. This ruling establishes parental rights from birth and ensures that the surrogate has no parental rights and does not appear on the birth certificate, providing legal certainty from the very beginning of the process.

The amparo is a legal proceeding through which a judge grants advance recognition of parental rights to the intended parents. It is mandatory because it ensures that all medical steps take place only after parental rights are legally protected, minimizing legal risk and providing a clear legal framework before embryo transfer.

The legal process typically takes 4 to 6 months. During this time, medical and psychological evaluations of the surrogate are carried out in parallel. Once the court ruling is finalized, the surrogacy agreement is signed and medical preparation for embryo transfer begins, allowing both processes to move forward in a coordinated and structured way.

Most families travel two times. The first trip is usually short and may coincide with legal or medical coordination. The second trip takes place at the time of birth. Most of the families, the stay after delivery is typically 3 to 5 weeks, depending on the completion of the baby’s documentation and U.S. consular procedures.

The surrogate cannot change her mind regarding parental rights. Because the court ruling is obtained before pregnancy, parental rights are legally assigned to the intended parents in advance. This eliminates custody disputes and protects the family throughout the entire journey.

Sinaloa has clear and established legislation regulating gestational surrogacy, which allows courts to grant parental rights before embryo transfer and before pregnancy begins.

In contrast, Mexico City does not have specific surrogacy legislation. In most cases there, parental recognition occurs during pregnancy or after the baby is born, which means intended parents are not legally recognized from the start. This can create legal uncertainty and unnecessary risk. By working in Sinaloa, the process is structured to provide legal clarity and protection from day one, giving families peace of mind before any medical step is taken.

After birth, a Mexican birth certificate is issued listing the intended parents as the legal parents. With this document, families can apply for the U.S. passport and/or the Consular Report of Birth Abroad (CRBA). For U.S. citizenship purposes, at least one of the intended parents must have a biological connection to the baby through the embryo, as required under U.S. law. Our team guides families through each step of the documentation and consular process to ensure a smooth and well-coordinated return to the United States.
